This is an appeal from a conviction of burglary of a habitation. Appellant pled guilty and in accordance with plea negotiations adjudication of guilt was deferred and he was placed on probation. Over two years later a motion to adjudicate guilt was filed. The appellant plead ""not true"", but following a hearing he was adjudged guilty and sentenced to twelve years confinement. The controlling issue is whether appellant has been denied a statement of facts for appeal. We affirm the judgment of the trial court. The state contests our jurisdiction to entertain this appeal. Citing Galitz v. State, 617 S.W.2d 949 (Tex. Crim. App. 1981) and art. 44.02, Tex. Code Crim. Proc. Ann. (Vernon Supp. 1986), the state argues that since the appellant neither appealed from adverse rulings on pre-trial motions nor received permission from the trial court to appeal, this court does not have jurisdiction. We disagree.
